The Centennial Projects Tax Status Act, S.M. 1988-89, c. 38

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

Definition of "centennial project"
1 In this Act "centennial project" means
(a) the centennial centre as that term is defined in The Centennial Centre Corporation Act;
(b) the lands owned by the Crown in right of Manitoba or by Manitoba Properties Inc. within the area at the south-west corner of Avenue Provencher and Rue des Meurons in the City of Winnipeg and all buildings and structures erected thereon and used or to be used for the purposes of Le Centre Culturel Franco-Manitobain including any lands and buildings thereon the title to which may be acquired for purposes of Le Centre Culturel Franco-Manitobain;
(c) the lands, including all buildings and structures thereon, owned by the Winnipeg Art Gallery within the area bounded in the east by Memorial Boulevard, on the north-west by Colony Street, and on the south by St. Mary Avenue, in the City of Winnipeg, and used or held for the purposes of an Art Gallery;
(d) the lands, including all buildings and structures thereon or to be erected thereon, now or hereafter owned by The Royal Winnipeg Ballet or any corporation which it causes to be incorporated for the purpose of holding title thereto, within the area in The City of Winnipeg bounded on the West by Edmonton Street on the South by St. Mary Avenue on the East by Carlton Street and on the North by Graham Avenue, and used or held for the purposes of The Royal Winnipeg Ballet;
(e) the lands, including all buildings and structures thereon, commonly known as 184 Alexander Avenue in the City of Winnipeg, owned by the Ukrainian Cultural and Educational Centre and used for the purposes of a cultural and educational centre; and
(f) that portion of the lands, including all buildings and structures thereon, commonly known as Portage Place and situated within the area in The City of Winnipeg bounded on the south by Portage Avenue, on the west by Vaughan Street, on the north by Ellice Avenue and on the east by Carlton Street, leased to and occupied by Prairie Theatre Exchange and used or held for the purposes of Prairie Theatre Exchange.

1 Dans la présente loi, « projet du centenaire » s'entend :
a) du Centre du centenaire tel que ce terme est défini dans la Loi sur la Société du Centre du centenaire;
b) des biens-fonds appartenant à la Couronne du chef du Manitoba ou à « Manitoba Properties Inc » compris dans la région située à l'angle sud-ouest de l'avenue Provencher et de la rue des Meurons dans la Ville de Winnipeg ainsi que les bâtiments et constructions y érigés, utilisés ou destinés aux fins du Centre culturel franco-manitobain, y compris les biens-fonds et les bâtiments y érigés dont le titre peut être acquis aux fins du Centre culturel franco-manitobain;
c) des biens-fonds, y compris les bâtiments et les constructions y érigés, appartenant à la Galerie d'Art de Winnipeg et situés dans la région délimitée à l'est par le boulevard Memorial, au nord-est par la rue Colony et au sud par l'avenue St. Mary, dans la Ville de Winnipeg, et utilisés ou détenus aux fins d'une galerie d'art;
d) des biens-fonds, y compris les bâtiments et les constructions érigés dessus ou qui le seront, appartenant actuellement ou ultérieurement au Ballet Royal de Winnipeg ou à toute corporation que celui-ci fait constituer en corporation afin d'en détenir le titre, qui sont situés dans la région de la Ville de Winnipeg délimitée à l'ouest par la rue Edmonton, au sud par l'avenue St. Mary, à l'est par la rue Carlton et au nord par l'avenue Graham, et qui sont utilisés ou détenus pour les fins du Ballet Royal de Winnipeg;
e) des biens-fonds, y compris les bâtiments et constructions y érigés, habituellement désignés comme sis au 184, avenue Alexander dans la Ville de Winnipeg, appartenant au Centre ukrainien de culture et d'éducation, et utilisés aux fins d'un centre culturel et éducatif;
f) la partie des biens-fonds, y compris les bâtiments y érigés, connue sous le nom de Place Portage, située dans la région de la ville de Winnipeg délimitée au sud par l'avenue Portage, à l'ouest par la rue Vaughan, au nord par l'avenue Ellice et à l'est par la rue Carlton, louée au « Prairie Theatre Exchange », occupée par celui-ci et utilisée ou détenue à ses fins.

Exemption
3 Section 2 does not apply to a tax imposed on a person attending a performance, exhibition or display in a centennial project and based on the amount of fee or charge paid by the person in respect of his attendance.
Exception
3 L'article 2 ne s'applique pas à la taxe imposée à la personne qui assiste à un spectacle, à une exposition ou à un exhibit dans un projet du centenaire et fondée sur le montant du droit ou des frais payés par la personne à l'égard de sa participation.

Grants in lieu
5 Notwithstanding any other Act of the Legislature, the government shall not make any grant in lieu of taxes to a municipality in respect of a centennial project.

Transfer of title
6 Where a centennial project ceases to be used for the purposes for which it was constructed, the owner thereof shall transfer title thereto to the government.

6 Lorsqu'un projet du centenaire cesse d'être utilisé aux fins pour lesquelles il a été construit, son propriétaire en transfère le titre au gouvernement.
Restriction on transfer
7 The owner or operator of a centennial project shall not transfer title to the centennial project, or encumber the title to the centennial project in any manner without the prior approval of the Lieutenant Governor in Council; and any purported transfer or encumbrance of a centennial project that is not approved by the Lieutenant Governor in Council is void.

7 Le propriétaire ou l'exploitant d'un projet du centenaire ne peut transférer ni grever le titre d'un projet du centenaire sans le consentement préalable du lieutenant-gouverneur en conseil. Tout prétendu transfert ou toute prétendue charge d'un projet du centenaire qui n'est pas approuvé par le lieutenant-gouverneur en conseil est nul.
Non-application of sections 6 and 7
8 Sections 6 and 7 do not apply and are deemed never to have applied to any of the centennial projects described in clauses 1(d), (e) and (f).
